Welcome to Withers Originals. By placing an order or using our website, you agree to the following terms and conditions. Please read them carefully.

  1. General Policies
  • Business Operations: Withers Originals is a home-based bakery operating under the state of Kansas Cottage Food Laws. My products are made in a kitchen that is not subject to government licensing or inspection.
  • Allergen Notice: Our products may contain or come into contact with common allergens, including wheat, eggs, dairy, soy, peanuts, tree nuts, and sesame. I cannot guarantee an 100% allergen-free environment.
  1. Orders & Payments
  • Ordering Process: All orders are considered custom and made-to-order. Orders are not confirmed until a deposit or full payment (as specified in your quote) is received.
  • Pricing: Quotes are valid for 14 days. Prices are subject to change based on the complexity of the design or current market costs for ingredients.
  1. Changes & Cancellations
  • Final Sales: Due to the handcrafted and perishable nature of our products, all sales are final.
  • Modifications: I require several days of preparation for every order. While I strive to accommodate requests, I cannot guarantee changes or cancellations once an order is finalized. Please contact me immediately if you need to adjust an order.
  1. Shipping & Delivery
  • Carrier: All shipped orders are sent via UPS Ground.
  • Shipping & Handling Fees: Any quote for a shipped order will include a combined Shipping and Handling fee. The “Shipping” portion covers the carrier’s fee, while “Handling” covers specialized packaging materials and the time required to ensure your treats arrive safely.
  • Liability: Once a package is handed over to the carrier, Withers Originals is not responsible for delays, damage, or loss caused by the carrier or weather conditions.
  1. Intellectual Property & Trademarks (please see – Intellectual Property & Trademark Policy)
  • Third-Party Logos: Withers Originals respects intellectual property rights. I will not use trademarked logos or characters without express written permission from an authorized representative of the trademark owner.
  • Custom Designs: Customers requesting trademarked imagery must provide written authorization. I reserve the right to refuse any design I believe infringes on a third party’s rights.
  1. Product Care & Quality
  • Storage: Proper storage instructions will be provided upon pickup or delivery. Withers Originals is not liable for products that degrade due to improper storage or environmental conditions (e.g., heat or humidity) once in the customer’s possession.
  • Artistic Interpretation: For custom designs based on provided photos, please note that I provide our own artistic interpretation and do not guarantee an exact 1:1 replica.
  1. Limitation of Liability
  • By purchasing from Withers Originals, you agree that my total liability for any claim arising out of the order shall not exceed the total price paid for the products in question.
  1. Governing Law
  • These terms are governed by the laws of the State of Kansas.
