Intellectual Property & Trademark Policy

• Respect for Trademarks: Withers Originals respects the intellectual property rights of others. I will not recreate trademarked logos, characters, or copyrighted images on any products without express written permission from the trademark owner or an authorized representative.
• Customer Responsibility: If you request a design that includes a trademarked logo or image, you are responsible for obtaining the necessary authorization. Written proof of this permission must be provided to Withers Originals before the order is finalized.
• Corporate/Organization Orders: For company events or functions where the customer is the trademark owner, we require a statement of authorization to use the logo for the specific event.
• Alternatives to Trademarked Designs: If permission cannot be obtained, we offer several legal alternatives:
• Themed Designs: We can create custom designs that use colors and themes inspired by a character or brand without replicating the protected logo or character itself.
• Licensed Edible Images: We may use pre-printed, licensed edible images from authorized suppliers where available.
• Right of Refusal: Withers Originals reserves the right to refuse any order that may infringe upon a third party’s intellectual property rights.
• Indemnification: By placing an order with Withers Originals, you agree to indemnify and hold us harmless from any and all claims, damages, or legal fees arising from any trademark or copyright infringement related to the design you requested.
